ZionAreaRentals, operated by BPemberton LLC, provides car rentals, guided tours, and vehicle sales across Southern Utah. By using our website, booking rentals, purchasing vehicles, or engaging with any of our services, you agree to all terms and policies outlined on this page.

TERMS OF SERVICE

1. Business Identity

BPemberton LLC is a legally registered business in the State of Utah, doing business as ZionAreaRentals. All services are operated in compliance with Utah state regulations.

2. Use of Services

By booking or using our services, you agree to:

Provide accurate personal information
Comply with all rental terms, Utah driving laws, and safety rules
Use company vehicles responsibly and only on publicly maintained roads
Avoid off-roading, smoking in vehicles, unauthorized drivers, illegal activities, and misuse
3. Rental Requirements

Renters must:

Be at least 21 years old
Hold a valid U.S. driver’s license
Accept all financial responsibility for the vehicle during the rental period
Follow all policies outlined in their rental agreement
4. Payments & FeesAll payments must be completed before pickup.
All rentals are non-refundable once the rental period begins.
Final charges may change if additional fees occur (cleaning, mileage, late returns, fuel, Smoking, damages, citations, policy violations).
5. Modification of Service

We may update services, pricing, policies, and terms at any time without prior notice.
 Continued use constitutes acceptance of updated terms.

6. Limitation of Liability

ZionAreaRentals is not responsible for:

Personal injuries, lost items, or property damage
Accidents, weather events, road conditions, or third-party actions
Incorrect use of vehicles or failure to follow safety rules
Use of our services is at your own risk.

7. Governing Law

All disputes shall be governed by Utah law, with jurisdiction in Washington County, Utah.

LIABILITY WAIVER

By booking, paying for, or operating a rental vehicle from ZionAreaRentals, you acknowledge and agree to the following:

1. Assumption of Risk

Driving or being transported in a motor vehicle involves risks including accidents, injuries, wildlife encounters, weather conditions, and road hazards.
 You voluntarily assume all such risks.

2. Release of Liability

To the fullest extent allowed by Utah law, you release BPemberton LLC / ZionAreaRentals from liability for:

Injuries
Property loss
Vehicle accidents
Delays
Natural conditions
Third-party actions

You agree that the Company is not responsible for damages arising from your actions, negligence, misuse, or failure to follow instructions.

3. Responsibility for DamagesYou agree to be financially responsible for:All damages to the rental vehicle
Towing expenses
Lost keys
Cleaning or smoking fees
Traffic or parking violations
Any costs caused by misuse or policy violations
4. Medical & Emergency ResponsibilityYou understand that the Company does not provide medical coverage and is not responsible for emergency expenses.5. Indemnification

You agree to indemnify and hold harmless BPemberton LLC for claims arising from your use of the vehicle.

By completing your reservation or taking possession of a rental vehicle, you accept the conditions of this waiver.
